Welcome to The Breath Nurse. These Terms & Conditions (“Terms”) govern your use of www.thebreathnurse.com (the “Site”) and your purchase or participation in services, events, programs, digital content, and other offerings provided by The Breath Nurse and Rachele Scevola (“The Breath Nurse,” “we,” “us,” or “our”).

By using this Site, booking or purchasing a service, registering for an event, purchasing a plan or package, or otherwise participating in an offering from The Breath Nurse, you agree to these Terms.

1. Eligibility

The Site may be viewed by the general public, but participation in breathwork services and experiences offered by The Breath Nurse is limited to individuals who are at least 18 years old unless otherwise expressly agreed in writing.

By purchasing or participating in a service, you represent that you are legally capable of entering into an agreement and that the information you provide is accurate and complete.

2. Services

The Breath Nurse may offer services including, but not limited to:

• Private breathwork sessions

• Breathwork packages and ongoing plans

• Group and retreat breathwork

• Corporate and workplace wellness experiences

• Public classes and events

• Online experiences and replays

• Coaching and wellness education

• Lifestyle and environmental wellness guidance

• Healthy Home Assessments offered in partnership with Lindenhaus + CLEAN Elements™

• Other wellness-related services, programs, collaborations, and educational offerings

 

Offerings, pricing, availability, formats, and inclusions may change from time to time.

3. Wellness Services; Not Medical Care

The Breath Nurse provides breathwork, coaching, wellness education, and related services intended to support general health and well-being.

​

Although Rachele Scevola, BSN, RN is a licensed Registered Nurse, services provided through The Breath Nurse are not provided as medical or nursing care and are not a substitute for medical care, mental health treatment, diagnosis, or treatment.

Participation does not establish a healthcare provider-patient relationship.

Information shared through the Site, email, social media, sessions, events, programs, or other materials is provided for educational and wellness purposes only.

​

You are responsible for seeking appropriate licensed medical or mental health care for individual health concerns.

​

4. Breathwork Participation and Assumption of Risk

Breathwork may involve physical, mental, and emotional sensations or responses. These may include changes in breathing, tingling, muscle tension, temperature changes, dizziness or lightheadedness, emotional responses, fatigue, or other temporary sensations.

By participating, you acknowledge that breathwork involves inherent risks and agree to participate voluntarily and within your own limits.

You are responsible for determining whether participation is appropriate for you and for disclosing relevant information requested through intake or participation forms.

​

Breathwork may not be appropriate during pregnancy, recent postpartum recovery, or for individuals with certain serious, acute, or unmanaged physical or mental health conditions unless cleared by an appropriate licensed healthcare provider.

Additional participation guidelines or contraindications may be provided on individual booking or event pages and are incorporated into these Terms.

Never participate in breathwork while driving, operating machinery, in or near water, or in any environment in which dizziness, relaxation, emotional activation, or reduced awareness of your surroundings could create a safety risk.

You may slow down, modify, pause, or stop a breathwork practice at any time.

​

5. Results Are Not Guaranteed

Wellness practices affect people differently.

​

Descriptions of possible benefits, client experiences, testimonials, or examples are not guarantees that you will experience the same outcome.

​

Your results may depend on numerous individual factors, including participation, lifestyle, health, circumstances, and choices made outside of a session.

​

6. Booking and Payment

Prices are listed in U.S. dollars unless otherwise stated.

​

Payment may be required in full at the time of booking or according to the payment schedule provided for a package, plan, custom experience, or invoice.

​

A booking is not considered confirmed until any required payment, forms, agreements, or other requested information have been received.

​

The Breath Nurse reserves the right to modify pricing for future bookings at any time. Price changes will not affect services already purchased unless otherwise agreed.

​

7. Packages, Plans, and Recurring Services

Packages and plans are intended to be used within the time frame described at the time of purchase or otherwise agreed upon.

Unused sessions are non-refundable unless otherwise required by law or expressly stated in writing.

​

If you purchase a recurring subscription or automatically renewing plan, you authorize the payment method on file to be charged according to the billing schedule disclosed at checkout until the plan is canceled.

​

Cancellation of a recurring plan stops future renewals but does not ordinarily create a refund for payments already processed.

Any specific package or subscription terms presented at checkout are incorporated into these Terms.

8. Cancellation and Rescheduling

Unless otherwise stated for a particular service:

​

Private 1:1 sessions must be canceled or rescheduled at least 24 hours before the scheduled session.

​

Cancellations or rescheduling requests made within 24 hours may be considered final and non-refundable.

​

No-shows may be treated as completed sessions and are non-refundable.

​

Private groups, retreats, corporate experiences, travel-based services, and custom engagements may require additional notice.

​

Applicable cancellation terms will be included in the proposal, invoice, contract, or booking confirmation.

​

Exceptions, credits, refunds, or rescheduling accommodations are made at the sole discretion of The Breath Nurse unless otherwise required by law.

9. Events, Workshops, and Replays

Unless otherwise stated on an event page, registration fees for public events, classes, workshops, and digital replays are non-refundable.

​

If a replay is included, availability dates and access limitations will be provided with the event information.

​

Replay access is intended only for the registered participant and may not be shared, copied, downloaded, reproduced, distributed, or resold unless expressly permitted.

​

If The Breath Nurse cancels an event and no reasonable rescheduled date or substitute offering is provided, affected participants will receive a refund or credit as appropriate.

​

10. Online Services and Technology

Online services may be delivered using third-party platforms such as Zoom or other technology providers.

​

You are responsible for having a functioning device, internet connection, audio equipment, and appropriate private environment.

​

The Breath Nurse is not responsible for interruptions or inability to participate caused by a participant’s internet connection, device, software, or other technology issue.

​

If a significant technical problem attributable to The Breath Nurse prevents delivery of a paid service, we will make reasonable efforts to reschedule, provide alternative access, or otherwise address the issue.

​

11. Group, Retreat, Corporate, and Travel-Based Services

Custom group, retreat, corporate, team, and organizational experiences are confirmed according to the terms provided in the applicable proposal, quote, contract, invoice, or confirmation.

​

Pricing may vary based on group size, location, session length, preparation, travel, event format, and other requirements.

​

For services requiring travel, the client or event organizer may be responsible for airfare, lodging, ground transportation, mileage, parking, or other agreed travel expenses.

​

Non-refundable travel expenses already incurred may remain the responsibility of the client if an engagement is canceled or rescheduled.

​

Where custom written terms conflict with these general Terms, the specific written agreement for that engagement will control.

​

12. Healthy Home Assessments and Third-Party Recommendations

The Breath Nurse offers Healthy Home Assessments in partnership with Lindenhaus + CLEAN Elements™.

​

Certain Healthy Home services, recommendations, purchases, or client information may be facilitated through CLEAN Elements or other third-party platforms and are also subject to those companies’ own terms and privacy policies.

​

The Breath Nurse may receive compensation from certain products or services purchased through the CLEAN Elements platform.

Healthy Home Assessments and environmental wellness recommendations are educational and informational in nature and are not medical diagnosis, medical treatment, environmental engineering, building inspection, remediation certification, or a guarantee that a home is free from environmental hazards.

​

When specialized testing, inspection, remediation, medical care, or other professional services are appropriate, you should consult a qualified professional in that field.

​

13. Intellectual Property

The Site and materials created by The Breath Nurse—including text, branding, graphics, photographs owned by us, recordings, meditations, breathwork guidance, worksheets, presentations, course materials, session materials, and other original content—are protected by intellectual property laws.

​

Unless expressly stated otherwise, materials are provided for your personal, non-commercial use.

​

You may not reproduce, record, copy, distribute, sell, publish, teach, modify, repurpose, or create commercial works from our materials without prior written permission.

​

Participants may not independently record private sessions, group sessions, classes, events, or other experiences without prior permission.

​

14. Recordings, Testimonials, and Media

Some events may include recordings or replays. When recording occurs, the event description or facilitator will explain what is being recorded and how it may be used.

​

The Breath Nurse will not intentionally publish a participant’s private session, identifiable image, testimonial, or personal story for marketing purposes without permission.

​

If you voluntarily provide a testimonial and authorize its use, we may edit it for length or clarity without materially changing its meaning.

​

15. Third-Party Websites and Services

The Site may contain links to third-party websites or services, including CLEAN Elements, Lindenhaus, Zoom, Eventbrite, social-media platforms, scheduling tools, and other providers.

​

We are not responsible for the availability, content, security, privacy practices, products, or services of third-party websites.

​

Your use of third-party platforms is subject to their own terms and policies.

​

16. Gift Cards

Gift cards, if offered, may be used toward eligible services according to the terms stated at purchase.

​

Gift cards are not redeemable for cash except where required by law.

​

Any expiration, transfer, redemption, or other terms will comply with applicable law.

​

17. Website Availability and Accuracy

We make reasonable efforts to keep Site information accurate and current but cannot guarantee that all content will always be complete, error-free, or current.

​

We may modify, suspend, discontinue, or update portions of the Site or our offerings without notice.

​

18. Limitation of Liability

To the fullest extent permitted by applicable law, The Breath Nurse and Rachele Scevola will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or participation in our services.

​

To the fullest extent permitted by law, our aggregate liability arising from a paid service will not exceed the amount actually paid to The Breath Nurse for the specific service giving rise to the claim.

​

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

​

19. Privacy

Your use of the Site is also governed by our Privacy Policy.

20. Governing Law

These Terms are governed by the laws of the State of North Carolina and applicable federal law, without regard to conflict-of-law principles.

​

Any dispute that cannot be resolved informally will be brought in an appropriate state or federal court with jurisdiction in North Carolina, unless applicable law requires otherwise.

​

Before commencing formal proceedings, the parties are encouraged to make a good-faith effort to resolve the dispute directly.

21. Changes to These Terms

We may update these Terms from time to time.

​

The current version and effective date will be posted on this page. Continued use of the Site or purchase of services after an update constitutes acceptance of the revised Terms to the extent permitted by law.

22. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
